Nicole Curtis, renowned for her role on HGTV’s Rehab Addict, has been embroiled in a legal battle with her ex-partner Shane Maguire for several months, as reported by RadarOnline.com.
Recently obtained court documents from RadarOnline.com reveal that earlier this year, Shane sought a modification of the existing custody arrangement and rules, alleging that Nicole was creating difficulties in their shared parenting responsibilities.
Nicole Curtis Custody Battle
In 2018, Nicole and her ex-partner reached a settlement, avoiding a contentious trial. They agreed to joint physical and legal custody of their 6-year-old son, Harper.
The terms prohibited both parties from speaking negatively about each other in Harper’s presence or attempting to alienate the child. Additionally, Nicole was obligated to establish a $250k trust for Harper, with Shane allowed to use the funds to purchase a condominium within 25 miles of Nicole’s new California residence. Shane agreed to repay the amount before their son’s 19th birthday.
Before the agreement, the custody battle had been acrimonious, with Shane accusing Nicole of attempting to damage his relationship with Harper and deeming her unfit for joint custody. Nicole refuted these allegations.
In a recent motion, Shane requested modifications to the custody agreement concerning Harper’s travel and summer break. He proposed adding a provision requiring prior written consent for either party to travel outside California with Harper. Additionally, he suggested that Harper should not miss school days without a valid reason and proposed a framework for both parties to have two weeks of vacation each during the child’s summer break.
In his legal filing, Shane contended that the initial agreement was established when Harper was only 3 years old. He emphasized that now, at the age of 6, changes have ensued, particularly due to the child’s enrollment in school.
Shane raised concerns about Nicole’s custodial practices, noting that she frequently travels with Harper, often taking late-night flights and returning him home during the early morning hours before a school day.
According to Shane, this schedule is detrimental to their son, who has expressed discomfort with getting home so late on the eve of a school day. Another issue Shane highlighted was Nicole’s lack of advance notice regarding trips; he claimed that she often informed him of Harper’s departure just minutes before boarding a plane.
In the court documents, Shane asserted, “The current orders are not working because Nicole makes every single Halloween a miserable ordeal for all of us, including Harper.” He elaborated on his willingness in past years to let Nicole dictate Halloween plans to avoid conflict but expressed frustration with the recurrent challenges when she doesn’t get her way.
